Who Owns the Windows, Balcony or Front Door in an Ottawa Condo?
One of the most expensive condo mistakes is assuming everything attached to your unit is your responsibility—or assuming the corporation will replace it. The answer depends on that condominium’s declaration, bylaws and maintenance obligations.
Items that often cause confusion
Windows and exterior doors
Balconies, terraces and exclusive-use yards
HVAC equipment, heat pumps and fan-coil units
Garage doors, driveways and fences in condo townhomes
Plumbing or electrical components serving one unit
Ownership and maintenance are different
An item can be a common element while the owner remains responsible for cleaning, routine maintenance or part of its replacement. “Exclusive use” does not necessarily mean privately owned.
How to confirm responsibility
Your lawyer should review the declaration, bylaws, rules and status certificate. I also look for clues in meeting minutes, reserve-fund plans and past sales. Your insurer and inspector may need to weigh in on major components.
Why it matters
Older windows, a failing heat pump or a deteriorating balcony can change the true value of a unit. Confirm who pays before removing conditions—not after closing.
